These Terms & Conditions ("Terms") govern your use of Studio Buddy ("the Service"),
operated by Studio Buddy ("we", "us", "our"). By creating a trial account or otherwise using
the Service, you confirm that you have read, understood and agree to be bound by these Terms.
1. Your free trial
Studio Buddy is offered on a 30-day free trial with up to 100 GB of photo storage and no
payment card required. The trial begins when your site is created and gives you access to the
full product. When the trial ends, your site is paused until you take out a paid subscription.
We may change the trial length, storage limits or features at any time.
2. Your account and security
You are responsible for keeping your admin login details secure and for all activity that
takes place under your account. You must provide accurate information when signing up and tell
us promptly of any unauthorised use. We may refuse or remove duplicate or abusive sign-ups.
3. Acceptable use and content standards
You are responsible for everything published on your site — its wording, menus, images and
files. In particular, you agree that:
- Site menu, page and section names must not be modified to display offensive, abusive,
discriminatory or otherwise inappropriate wording.
- All images and files you upload must be legal, and you must own them or have the rights and
permissions needed to use and display them.
- Photographs must not be pornographic or sexually explicit, and must never exploit or
endanger children.
- You must not use the Service to break the law, infringe anyone's copyright or other rights,
harass any person, or store or distribute malware.
- You must handle your own clients' personal data and photographs responsibly and in line
with applicable data-protection law.
We may review content and remove anything, or suspend a site, that we reasonably believe
breaches these standards.
4. Your content and ownership
You keep ownership of the photographs and content you upload. You grant us the limited licence
needed to host, store, back up and display that content so that we can provide the Service. You
are responsible for keeping your own copies of your photographs; the Service is not a backup
service.
5. Suspension and termination
We reserve the right to suspend or terminate your account and remove your site at any time,
with or without notice, including (but not limited to) where we believe these Terms have been
breached. You may stop using the Service and ask us to close your account at any time.
On termination or account closure, for any reason, your site will be taken down and all
photographs, galleries, client records and other data associated with your account will be
permanently deleted and cannot be recovered. Please export or download anything you wish to
keep before your account ends.
6. Fees and subscription
Continuing to use the Service after the free trial requires a paid subscription. Subscription
pricing, storage allowances and payment terms will be shown to you before you subscribe. Fees
are non-refundable except where required by law.
7. Service availability
We work hard to keep the Service running, but do not guarantee that it will be uninterrupted,
error-free or available at all times. We may carry out maintenance and may change, suspend or
withdraw features from time to time.
8. Limitation of liability
The Service is provided "as is". To the fullest extent permitted by law, we are not liable for
any loss of data, loss of profit, or indirect or consequential loss arising from your use of,
or inability to use, the Service. Nothing in these Terms limits any liability that cannot
lawfully be limited.
9. Changes to these Terms
We may update these Terms from time to time. Where changes are significant we will make
reasonable efforts to let you know. Continuing to use the Service after changes take effect
means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of England and Wales, and any disputes are subject to the
exclusive jurisdiction of the courts of England and Wales.
